SECTION 404 / 10 PERMITS

Section 404 and Section 10 permits may be required for projects involving dredged or fill material in streams or wetlands, or structures and other work in certain state-designated navigable waters.

  • WHO NEEDS A SECTION 404 / 10 PERMIT?

    Section 404 may apply to projects involving the discharge or placement of dredged or fill material into waters of the United States, including streams and wetlands.

    Section 10 may apply to structures or other work in, over, under or affecting federally navigable waters.

    The U.S. Army Corps of Engineers determines whether a permit is required and what type of authorization applies.

    Section 404 and Section 10 applications are not submitted through Gilly.
